Summary

On September 30, 2011, the Canada Supreme Court unanimously ordered the federal Minister of Health to grant an exemption from the prohibitions of possession and trafficking of controlled substances to Insite (which operates a supervised injection site)under s. 56 of the Controlled Drugs and Substances Act. Section 56 provides for exemption at the discretion of the Minister of Health for medical an scientific purposes.
